Final call for observations on ADR Position Paper
The Irish Department of Public Expenditure and Reform (DPER), collaborating with the Government Contracts Committee for Construction (GCCC), has issued a final call for observations on a pivotal position paper concerning alternative dispute resolution (ADR) within public works contracts. This strategic initiative, integral to the Capital Works Management Framework (CWMF) development, aims not only to refine existing ADR mechanisms but fundamentally to embed greater dispute avoidance across public sector construction projects.
Accompanying the paper, titled 'Proposals to amend the alternative dispute resolution mechanisms in the public works contracts and promote the greater use of dispute avoidance', is a concurrent Indecon report. This report offers a critical assessment of the operational effectiveness of Standing Conciliator and Project Board roles, providing foundational insights for a more robust and efficient contractual environment.
